FEMALE SPEAKER 1: Your work’s not done just because a law has been
enacted. There may be some things that need to be communicated to people
who are going to be implementing that law going forward. Regulations are
proposed, developed, drafted, ultimately made permanent at the federal level by
the executive branch of government. Because laws are typically written fairly
broadly with broad language, and that means that when they’re past– a president
signs them into law and they get turfed over to the executive branch for
implementation– sometimes there is no need for regulation because it’s pretty
clear the intent.

But other times there’s a lot of regulatory activity that needs to occur to establish
the parameters of how that law is going to be implemented. So we need to pay
attention to that. Because getting a law passed is just one thing in many cases.
Getting the regulations that are implementing that language that act is equally
important because it can go lots of different directions. There are typically a lot of
options that can be selected. There isn’t just one right path.

FEMALE SPEAKER 2: The regulatory process is an important one because it
guides so much of nursing practice. At the federal level, we think of regulations
such as OSHA regulations or Medicare regulations. And those are important to
our patients. If we look at what might be important to our nurses, we have to look
at the state level at the Board of Nursing.

The Board of Nursing, again, is a governmental organization that protects the
public. In essence, that’s what they’re there for. They’re to protect the public, not
the nurse. So it’s important to become part of the Board of Nursing because
that’s the group that makes the decisions that affects your everyday life.

FEMALE SPEAKER 1: There’s a lot of reform underway to pull regulations back.
So I mention that to say it’s not just a matter of keeping your eye on new
regulations. It’s also to keep an eye on what those regulations that are being
removed from the books and what impact, if any, they have on health systems
and so on. In some cases, regs are absolutely out of date, and they should be
removed. And in other cases, that might be a compromise from our perspective–
a nurse’s perspective– to patients’ health if that regulation that is a consumer
protection is removed. So regulations merit tracking.
